Our company Watnext Industries Srl (you will find the contact details below) and its affiliated companies are looking forward to your download of our Watnext Unique App! The protection of your data and your privacy are of particular concern to us. 

The purpose of this privacy policy is to provide you, as a user of the Watnext Unique App (hereinafter referred to as the ‘app’), with transparent 

information about the processing of your personal data. 

We attach great importance to protecting your privacy and would like to inform you about what data we collect from you, how we use it and what rights you have in relation to your data. 

The processing of personal data is always carried out in accordance with the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to Watnext Industries Srl (eg.: Italian Personal Data Protection Code). 

By means of this data protection declaration, our company would like to inform the public about the type, scope and purpose of the personal data we collect, use and process and to inform you about the rights to which you are entitled. 

Watnext Industries Srl has taken appropriate technical and organisational measures to protect your data against loss, manipulation or unauthorised access. The measures taken are subject to regular review and are continuously adapted to the state of the art. 

The data protection declaration only applies to the app and the associated subpages, but not to apps that are controlled and operated by third parties. Please check apps controlled and operated by third parties, as Watnext Industries Srl is not responsible for their content and data protection measures. 

 

1. General information 

 

The data protection declaration of Watnext Industries Srl is based on the terms used in the GDPR. 

‘Personal data’ means any information relating to an identified or identifiable natural person (hereinafter “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. ‘Non-personal data’ is anonymised and is information that cannot be traced back to the data subject under any circumstances. For this reason, non-personal data is not subject to data protection law. 

‘Data subject’ is any identified or identifiable natural person whose personal data is processed by the controller. 

‘Processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. 

‘Controller’ or “controller responsible for the processing” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law. 

‘Third party’ means a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorised to process the personal data. 

‘Consent’ means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her. Personal data will only be processed by us in accordance with the applicable data protection regulations. If you correspond with us or fill in a form on our website with data, you acknowledge that the data you provide in the respective form will be processed for the purposes described below.

3. Processing of personal data 

The App does not require user registration and does not create user profiles. Product-specific settings and counter values are processed locally on your device. Within the use of the app there is no processing of personal data. We provide you with the following details and regulations regarding data processing for information, transparency and legal purposes. 

Your personal data will be processed exclusively for the purposes stated in this privacy policy and to the extent necessary to achieve these purposes. This data will not be passed on without your consent, except in the cases described in this privacy policy and in the case of mandatory national legislation. 

However, we only use this data if you provide it to us and have expressly consented to its use in advance. In these cases, however, we will ask you for your consent at prominent points. 

Your personal data is processed on the basis of one or more of the following legal bases: your consent, the fulfilment of a contract with you, compliance with our legal obligations or the legitimate interests of us or third parties. 

 

3.1. App authorisations 

This app requires certain authorisations in order to function properly and offer you an optimal user experience. By installing and using this app, you consent to the collection and processing of your personal data in accordance with the provisions of this privacy policy. 

ACCESS_NETWORK_STATE: This permission allows the application to access information about the current network state, such as whether the device is connected to Wi-Fi or mobile data. It is used to determine the availability of an internet connection or network. 

 

INTERNET: This permission allows the application to access the internet. It enables the app to send and receive data over the network, such as making requests to web servers or fetching online content. 

 

ACCESS_COARSE_LOCATION: This permission allows the app to access approximate location data based on sources such as Wi-Fi networks or mobile cell towers. It does not provide precise location details but is used for general location-based services. 

 

ACCESS_FINE_LOCATION: This permission grants the app access to precise location data using GPS, Wi-Fi, or mobile networks. 

 

BLUETOOTH: This permission allows the app to interact with Bluetooth devices. It enables the app to discover and communicate with nearby Bluetooth-enabled devices. 

 

BLUETOOTH_ADMIN: This permission allows the app to perform administrative tasks related to Bluetooth, such as enabling or disabling Bluetooth on the device or managing Bluetooth connections. 

 

BLUETOOTH_CONNECT: This permission enables the app to connect to and interact with Bluetooth devices. It is necessary for making and maintaining Bluetooth connections with other devices. 

 

BLUETOOTH_SCAN: This permission allows the app to scan for nearby Bluetooth devices. It enables the app to detect and discover Bluetooth devices that are within range of the device. 

Please note that you can revoke these authorisations at any time in the settings of your device. The processed data within above mentioned necessary authorizations include no personal data. 

 

3.2. Safety measures 

We take appropriate technical measures in accordance with Art. 32 GDPR, taking into account the state of the art, the implementation costs and the type, scope, circumstances and purposes of the processing as well as the different probability of occurrence and severity of the risk for the rights and freedoms of natural persons and organizational measures to ensure a level of protection appropriate to the risk. 

The measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as the access, input, distribution, ensuring availability and its separation. We have also set up procedures to ensure that the rights of those affected are exercised, data are deleted and data are at risk. We also take the protection of personal data into account when developing or selecting hardware, software and processes, in accordance with the principle of data protection through technology design and through data protection- friendly default settings (Art. 25 GDPR). 

 

3.3. Hosting 

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services, which we use for the purpose of operating this online offering. 

In doing so, we, or our hosting provider, process no personal data but, inventory data, content data, usage data, meta and communication data from customers, interested parties and visitors to this online offering based on our legitimate interests in the efficient and secure provision of this online offering in accordance with Art. 6 Para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of order processing contract). 

 

3.4. External Link to Online Shop 

Within the app, users may be redirected to the Online Shop of a Partner from us via a dedicated page. This redirection occurs through the browser installed on your device. Please note that the Online Shop is operated by the Partner. The Partner is solely responsible for the processing of personal data in connection with the use of the shop. The applicable data protection provisions of the Partner apply and can be accessed directly within the shop. 

 

4. Contact 

If you contact us, the personal data you provide will be stored automatically. If you contact us by e-mail, the personal data you provide (e.g. title, name, address, telephone number, e-mail address) will be processed. The purpose of data processing is to process your enquiry. The legal basis for the processing is Art. 6 para. 1 lit. b) GDPR, which enables us to process the data if this is necessary for the fulfilment of a contract with you or for the implementation of a pre-contractual measure. 

 

5. International data transfer 

We process your personal data within the European Economic Area ("EEA") or in countries that have an adequate level of protection as determined by the European Commission (third country with an adequate level of protection). Where we transfer personal data to third countries outside the EEA, we ensure an adequate level of data protection through standard contractual clauses adopted by the European Commission. For transfers of data to the United States, we use the EU-US Data Privacy Framework to provide you with an adequate level of protection under the current regulation. PRIVACY

 

6. Affiliated companies 

Personal data is shared within our company and its subsidiaries (hereinafter referred to as ‘Affiliated Companies’). Our Affiliates are also included in this Privacy Policy and are subject to the same privacy policies and procedures. The transfer of personal data within our company and its Affiliates serves various purposes. This includes: 

Providing our services: In order to efficiently provide you with the services we offer, we may share your personal data with certain departments or our affiliates that are responsible for fulfilling your requests or orders. 

Improvement of services: In order to continuously improve the services we offer, we may analyse and evaluate personal data within the company and its affiliated companies in order to gain insights into your preferences and usage patterns. 

Customer support: In the event of enquiries or complaints, your personal data may be passed on to the relevant departments within the company or its affiliated companies in order to provide you with the best possible customer support. 

 

Access to your data is limited to authorized employees who need this information to perform their professional duties. 

The transfer of your personal data within our company and its affiliated companies takes place on the basis of your consent in order to fulfil the contractual relationship with you or to protect our legitimate interests, provided that these are not outweighed by your interests or fundamental rights and freedoms. 

There is an agreement between us as the data controller and our affiliated companies as processors in accordance with Art. 26 and 28 GDPR. You have the right to receive copies of these contracts. 

 

7. Storage period 

We store your personal data, if necessary, for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) and beyond, in accordance with the statutory retention and documentation obligations or for the defence of legal claims. The statutory retention periods under Italian law are, in particular, ten (10) years for commercial and accounting records pursuant to Art. 2220 of the Italian Civil Code and the applicable Italian tax regulations. Longer retention periods may apply where necessary for the establishment, exercise or defence of legal claims. 

 

8. Rights of data subjects 

With regard to the data processing described in more detail below, users and data subjects have the right 

to confirmation as to whether data concerning them is being processed, to information about the processed data, to further information about the data processing and to copies of the data (cf. also Art. 15 GDPR); 

to rectification or completion of incorrect or incomplete data (see also Art. 16 GDPR); 

the immediate erasure of the data concerning them (see also Art. 17 GDPR) or, alternatively, if further processing is required in accordance with Art. 17 para. 3 GDPR, the restriction of processing in accordance with Art. 18 GDPR; 

to receive the data concerning them and provided by them and to transfer this data to other providers/controllers (cf. also Art. 20 GDPR) 

to lodge a complaint with the supervisory authority if they are of the opinion that the data concerning them is being processed by the provider in breach of data protection regulations (see also Art. 77 GDPR). 

In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any correction or deletion of data or the restriction of processing that takes place on the basis of Art. 16, 17 para. 1, 18 GDPR. However, this obligation does not apply if this notification is impossible or involves a disproportionate effort. Notwithstanding this, the user has a right to information about these recipients. 

Users and data subjects also have the right to object to the future processing of data concerning them in accordance with Art. 21 GDPR, provided that the data is processed by the provider in accordance with Art. 6 para. 1 lit. f) GDPR. In particular, you have the right to object to data processing for the purpose of direct marketing. 

You can assert these rights at any time in writing directly to Watnext Industries Srl. Please note that we can only provide information about personal data if you can provide appropriate proof of your identity.
